This means the Crown decides whether to proceed by summary conviction or by indictment, an example of the broad discretion prosecutors hold. An act of mischief that damages property or a computer system, for instance, can be prosecuted summarily, but if the Crown proceeds by indictment a conviction could carry a term of imprisonment of up to two years. The Crown is more likely to proceed by indictment where the accused has a serious record or where the value or harm involved is substantial.
